In every EU country except Sweden, snus may not be sold. The rule is more than thirty years old, and it has survived two challenges before the Court of Justice of the European Union. This guide explains where the ban comes from, which reasons the EU gave and what the ban does not cover. It describes the law on 13 October 2026.
In short
- The EU first required a ban on tobacco for oral use in 1992.[1]
- The reasons given were the appeal of these products to young people, nicotine addiction and the risk of cancer of the mouth.[1]
- Sweden has an exception under its Act of Accession.[2]
- Tobacco-free nicotine pouches are not covered by the EU ban, but some countries ban them on a national basis.[2][6][7]
Why is snus illegal in the European Union?
Snus is illegal in the EU because EU law requires member states to prohibit the placing on the market of tobacco for oral use. Today, this rule is Article 17 of the Tobacco Products Directive 2014/40/EU.[2]
The directive explains the reason in recital 32: the ban should be maintained to prevent the introduction in the Union, apart from Sweden, of a product that is addictive and has adverse health effects.[2] The original reasons from 1992 are more detailed and are described in the next section.
Why is snus banned in Europe? The reasons from 1992
The EU wrote its reasons into the recitals of Council Directive 92/41/EEC. There are four main points.[1]
- Young people: new oral tobacco products had appeared on the market and were "particularly attractive to young people".[1]
- Addiction: the Council saw a real risk that these products would be used above all by young people, which would lead to nicotine addiction.[1]
- Cancer risk: the directive refers to studies of the International Agency for Research on Cancer, which found large quantities of carcinogenic substances in oral tobacco, and links the products to cancer of the mouth.[1]
- Internal market: three member states had already banned these products. Different national rules would disturb the internal market, so the Council chose a common rule. The directive states that the only appropriate measure was a total ban.[1]
These are the reasons the legislator gave in 1992. They describe the position of the EU institutions at that time, not the result of a new scientific review.
When was snus banned in the EU?
The EU ban dates from 1992. Directive 92/41/EEC of 15 May 1992 inserted a new Article 8a into the tobacco labelling directive, which told member states to prohibit the placing on the market of tobacco for oral use.[1]
Member states had to apply the new rule by 1 July 1992.[1] The ban was later carried over into Directive 2001/37/EC and then into Article 17 of Directive 2014/40/EU.[3][2] The United Kingdom, which was a member state at that time, implemented it with regulations that entered into force on 1 January 1993.[5]
| Year | Step |
|---|---|
| 1992 | Directive 92/41/EEC requires a ban on tobacco for oral use (Article 8a).[1] |
| 1995 | Sweden joins the EU with an exception for snus under Article 151 of its Act of Accession.[2] |
| 2001 | The ban continues as Article 8 of Directive 2001/37/EC.[3] |
| 2004 | The Court of Justice confirms the validity of the ban in case C-210/03.[3] |
| 2014 | The ban continues as Article 17 of Directive 2014/40/EU.[2] |
| 2018 | The Court of Justice confirms the ban again in case C-151/17.[4] |
| 2026 | The Commission publishes its evaluation of the tobacco rules and announces a revision.[8] |
Why is snus legal in Sweden?
Sweden has a legal exception. The Tobacco Products Directive states that the ban applies "without prejudice to Article 151 of the Act of Accession of Austria, Finland and Sweden", and recital 32 confirms that this article grants Sweden a derogation from the prohibition.[2]
The exception was agreed when Sweden joined the EU, and it applies only to Sweden. Snus that is sold legally in Sweden may not be sold in other EU countries. More details are in our guide on snus in Sweden.
Has the snus ban been challenged in court?
Yes, twice before the Court of Justice of the European Union, and both times the ban was upheld.[3][4]
In 2004, the Swedish producer Swedish Match challenged the ban in a case that came from the High Court of England and Wales. The Court of Justice found nothing that affected the validity of the ban in Directive 2001/37/EC.[3] In 2018, the Court examined the new ban in Directive 2014/40/EU in a second case brought by Swedish Match and again found nothing that affected its validity.[4]
A national ban was overturned once. The UK Oral Snuff (Safety) Regulations 1989 were quashed by the High Court in 1991, before the EU rule took effect.[5]
Which products does the snus ban cover?
The ban covers tobacco for oral use. The directive defines this as tobacco products for oral use, except those to be inhaled or chewed, made wholly or partly of tobacco, in powder or particulate form, especially in sachet portions or porous sachets.[2]
| Product | Covered by the EU ban? |
|---|---|
| Swedish snus (portion or loose) | Yes[2] |
| All-white snus that contains tobacco | Yes, because it contains tobacco[2] |
| Chewing tobacco | No, products intended to be chewed are excluded[2] |
| Tobacco-free nicotine pouches | No, they are not made of tobacco[2] |
The German authority BVL summarises the result for Germany: tobacco for oral use, such as snus, is not allowed, while chewing tobacco and nasal snuff remain permitted tobacco products.[9]
Why nicotine pouches are not part of the snus ban
The EU ban depends on tobacco. Nicotine pouches contain nicotine but no tobacco, so they do not meet the definition of tobacco for oral use.[2]
This does not mean that nicotine pouches are free to sell everywhere. Some member states have their own bans. The Netherlands prohibits placing nicotine products without tobacco for oral use on the market.[6] Belgium notified a Royal Decree to the European Commission that prohibits the placing on the market of nicotine pouches.[7] The rules for each country are listed in our overview of snus laws in Europe.
Will the EU snus ban be lifted?
The Commission has not announced such a plan. On 2 April 2026, the European Commission published its evaluation of the EU tobacco rules and announced that it intends to propose a revision in 2026.[8]
The Commission names e-cigarettes, heated tobacco products and nicotine pouches as new public health concerns, especially for young people.[8] The press release does not mention a plan to lift the ban on tobacco for oral use. What the revision will mean for nicotine pouches is described in our article on TPD3 and nicotine pouches.
